法律文化是以往人类法律实践活动的产物,是影响法制建设的深层次的因素。本文从传统法律文化固有的特征出发,与现代法制要求进行对照,在继承和改造并举的精神下,探寻我国法制现代化建设之路,争取走出一条符合我国国情的法制现代化之路。
Legal culture is a product of past human law practice and a deep-seated factor affecting the legal system. Based on the inherent characteristics of the traditional legal culture, this article contrasts with the requirements of the modern legal system and explores the road to the modernization of China’s legal system under the spirit of both inheritance and transformation so as to get out of a path of modernization of the legal system in line with China’s national conditions.
