根据《选举法》第43条规定,“全国和地方各级人民代表大会的代表,受选民和原选举单位的监督。选民或者选举单位都有权罢免自己选出的代表。”目前,各地的选区在表决罢免代表要求,人大常委会在审议通过罢免代表议案或发布公告中,常有“罢免代表资格”一说。我认为,此说似有不妥。《代表法》第二条第二款、第三款规定,“全国人民代表大会代表是最高国家权力机关组成人员,地方各级人民代表大会代表是地方各级国家权力机关组成人员。全国人民代表大会和地方各级人民代表大会代表,代表人民的利益和意志,依照宪法和法律赋予本级人民代表大会的各项职权,参加行使国
