信访制度是我国公民参政议政的方式之一,也是替代性纠纷解决机制的代表形式,在我国社会主义民主政治建设领域具有重要的地位和功能。然而,当前我国信访工作的实践情况却往往使信访制度的功能被误解和滥用,因此对信访制度的法治化完善已日益被学者和专家们所重视。对此,笔者通过对英国议会行政监察专员这一与我国信访制度有着相似功能的制度的研究,探索我国信访困境的出路。
The system of letters and visits is one of the ways for citizens to participate in politics in our country and is also the representative form of alternative dispute resolution mechanism. It plays an important role and function in the construction of socialist democratic politics in our country. However, the current practice of petition in our country often makes the function of the petition system misunderstood and abused. Therefore, the improvement of the legal system of the petition system has been paid more and more attention by scholars and experts. In this regard, the author through the British Parliamentary Ombudsman, a system that has a similar function with China’s letters and visits system, to explore the way out of the plight of our petition.
