能效标识能够有效缓解制造商与消费者之间的信息不对称,有利于消费者利益。能效标识可作为政府规制和市场自治的工具,实现政府的规制目标和企业的经济利益。在我国,政策为能效标识制度起指导性作用,立法给能效标识制度提供了法制保障,标准则是能效标识制度实现的程序规定和技术支撑。我国应建立并完善企业标准自我声明制度,并对能效标识提供商标法保护,以为能效标识制度作用的发挥提供周全的法制保障。
Energy efficiency labeling can effectively ease the information asymmetry between manufacturers and consumers, in the interest of consumers. Energy efficiency labeling can be used as a tool for government regulation and market autonomy to achieve the government’s regulatory objectives and the economic interests of enterprises. In our country, the policy plays an instructive role in the energy efficiency labeling system. The legislation provides the legal guarantee for the energy efficiency labeling system. The standard is the procedure regulation and technical support for the realization of the energy efficiency labeling system. China should establish and improve the enterprise standard self-declaration system and provide trademark protection for energy efficiency labeling so as to provide comprehensive legal protection for the role of energy efficiency labeling system.
