特留份制度是遗嘱继承中的一项重要内容,它是对遗嘱自由原则的合理限制,以其独特的价值和功能维护并平衡各继承当事人之间的权益。当今世界各国也都采用了这一制度,但在我国尚无相应的明确细致的规定,因此设立并完善该制度是十分必要的。本文就该制度的几方面内容作了简单论述,涉及了特留份制度的概述及我国的立法现状,还有完善该制度的几点建议。
The special reservation system is an important part of will inheritance. It is a reasonable limit to the principle of will-test freedom. It maintains and balances the rights and interests between the successors with its unique value and function. Nowadays, all countries in the world adopt this system. However, there is no clear and detailed stipulation in our country. Therefore, it is very necessary to establish and perfect this system. This article briefly discusses several aspects of the system, including an overview of the special reservation system and the status quo of legislation in our country, as well as suggestions on how to perfect the system.
