澳门的刑事法律制度深受葡萄牙立法的影响。本文通过一个澳门中级法院的判决,分析了单行刑法和刑法典在法律的模糊性与罪刑法定、实体法中的程序性规定与特别法的相互衔接关系,来说明统一刑事立法的重要性。澳门政府应该考虑整合、吸收单行刑法的有益部分,来解决不同刑事法律制度之间的融合性和一致性。
Macau’s criminal legal system is heavily influenced by the Portuguese legislation. This article analyzes the importance of unifying the criminal legislation by analyzing the ambiguity of the law and the connection between the procedural rules and the lex specialis in statutory and substantive law of a single criminal law and the criminal law through a judgment of a Macao Intermediate Court. The government of Macao should consider integrating and absorbing the beneficial part of the criminal law of the single bank to solve the integration and consistency between different criminal legal systems.
