随着我国房地产行业近年来的迅猛发展,大量商品房相继开发、建成、销售,随之产生了大量的房地产交易法律关系,而商品房买卖纠纷也相应大量出现。商品房买卖纠纷的出现固然是基于市场规律而无法避免的客观事实,但由于开发企业的原因,导致对本应避免或采取措施能够加以预防的风险没能进行合理、合法、有效的预防所导致的商品房买卖纠纷。在此,笔者就所总结的开发企业在房地产经营中可能会遇到的案例,结合相关法律、法规,将房地产开发企业在房地产买卖关系中的风险防范应对措施简述如下,以与各位读者及业内人士探讨。
