兩漢的獄訟活動,以告劾和逐捕首開其端。~([1])“劾”就是舉劾,在漢簡文書中,舉劾多由官吏發起,他們除了查明案情和逮捕案犯外,還負有提起訴訟和撰寫劾狀的職責。過去,西北地區的甲渠候官遺址中已經發現了漢代劾狀簡册的實物,前賢對此多有討論。~([2])這次出版的《長沙五一廣場東漢簡牘選釋》(下文簡稱《選釋》)收録了一件東漢中期的舉劾文書,~([3])爲我們進一步瞭解漢代劾狀的形制和結構,以及當時司法制度的運作,提供了寶貴的材料。
