因特网构建起的电脑信息空间,对传统知识产权制度提出了严峻挑战。对此,本文探讨了三种集中表现:新型信息作品对“内容、形式”二元论版权保护准则的冲击;法律保护在智力成果创作人利益与人力物力投入的投资者或竞争者利益之间如何平衡;网络域名管理规则如何解决种种纠纷。最后,本文认为,知识产权保护制度应采取“渐进”,而非“革命”的措施,来作为制度创新回应技术革命的设计思路
The computerized information space built up by the Internet poses a severe challenge to the traditional intellectual property system. In this regard, the paper explores three kinds of concentrated performance: the impact of new informational works on the copyright protection criterion of “content and form” dualism; how the legal protection balances the interests of the intellectual and the human and material resources investors or competitors ; How to solve all kinds of disputes in the rules of network domain name management. Finally, this paper argues that the system of intellectual property protection should take the “gradual” rather than “revolutionary” measures as a system innovation to respond to the technical revolution design ideas
