本文以我国的《档案法》、《著作权法》、《学位条例》、《普通高等学校档案管理办法》、《高等学校知识产权保护管理规定》等法规条文为依据 ,以不同于图书、情报部门而是从档案工作的角度 ,对高校学位论文档案的权利归属、开放利用、学校、学生权益保护等方面的问题从法律角度进行分析和探讨 ,并提出解决上述问题的几点建议 ,以更好满足学校、社会对学位论文档案的合法利用。
This article is based on the regulations and provisions of the Archives Law, Copyright Law, Academic Degrees Regulations, Regulations for the Management of Archives of General Institutions of Higher Learning and Provisions on the Administration of Intellectual Property Protection in Institutions of Higher Learning in China, But from the perspective of archives work, this paper analyzes and discusses the issues of ownership, open utilization, protection of rights and interests of schools and students in dissertations and dissertations of colleges and universities from the legal point of view, and puts forward some suggestions to solve the above problems so as to make better Satisfy the legitimate use of theses and dissertations in schools and society.
