党的十四大明确提出,我国经济体制改革的目标,是建立和完善社会主义市场经济体制。在八届全国人大第一次会议上审议通过的宪法修正案明确规定“国家实行社会主义市场经济”,这就确立了社会主义市场经济体制在我国的法律地位。党的十四届三中全会通过的《中共中央关于建立社会主义市场经济体制若干问题的决定》,构造了社会主义市场经济体制的框架,是一个纲领性文件。社会主义市场经济从某种意义上说就是法制经济,其体制的建立和完善,必须有完备的法制来规范和保障。
The 14th National Congress of the CPC made it clear that the goal of China’s economic restructuring is to establish and improve the socialist market economy. The amendment to the constitution examined and passed at the first session of the Eighth NPC has clearly stipulated that “the state implements the socialist market economy,” which establishes the legal status of the socialist market economic system in our country. The “Decision of the CPC Central Committee on Several Issues Concerning the Establishment of a Socialist Market Economic System” adopted at the Third Plenary Session of the 14th Central Committee of the Party constitutes a framework document for the socialist market economic system and is a programmatic document. In a sense, the socialist market economy is the legal economy. The establishment and perfection of its system must have a complete legal system to regulate and protect it.
