中国有着深厚的刑事和解制度生存土壤。历史的“和合”司法观念决定了中国的法制传统可以接纳刑事和解制度;从政治国家向市民社会的变迁则决定了中国社会迫切需要建立刑事和解制度;而国家和个人最大化的效益追求也预示着刑事和解制度的建立已成为了国家和个人的内在需求。刑事和解制度不但能够在中国建立,而且完全有必要在中国推广。
China has a deep soil for criminal reconciliation system. The historical justice of “harmony” determines that the legal tradition in China can accept the criminal reconciliation system; the transition from a political state to a civil society determines the urgent need of establishing a system of criminal reconciliation in Chinese society; and the pursuit of efficiency for the maximization of the state and individual It also indicates that the establishment of the criminal reconciliation system has become an inherent demand of the country and the individual. The system of criminal reconciliation can not only be established in China, but it is absolutely necessary to promote it in China.
