《商标法》、公共利益两者之间存在着非常密切的关联,公共利益在《商标法》之中的主要体现为保障消费者的合法利益,以促进有效竞争,最终增进公共利益。《商标法》主要通过制止商标侵权行为、维护公平竞争秩序这两种手段,来实现促进有效竞争、增进公共利益的目的。《商标法》主要通过确保生产者为一般消费者提供具有相同质量的商品,并让消费者在零售环境中确认,来实现保障消费者的合法利益、增进公共利益的目的。本篇论文主要对《商标法》中的公共利益进行了探讨与分析,以供参考。
There is a very close relationship between the “Trademark Law” and the public interest. The main manifestation of the public interest in the “Trademark Law” is to protect the legitimate interests of consumers so as to promote effective competition and ultimately enhance the public interest. The “Trademark Law” mainly aims at promoting effective competition and enhancing the public interest by means of stopping trademark infringement and safeguarding the order of fair competition. The “Trademark Law” aims at protecting the legitimate interests of consumers and promoting the public interest mainly by ensuring that producers provide goods of the same quality to consumers in general and allow consumers to confirm them in the retail environment. This paper mainly discusses and analyzes the public interest in the Trademark Law for reference.
