近年来,犯罪心理学的高速发展和影响力让我们看到了它对分析犯罪行为和预测社会安全度的显著作用。在司法实践中,一个犯罪行为被定性后,犯罪主体心理的剖析研究不仅可以起到定罪量刑的重要作用,还可以验证客观证据的合法可采性。在学术领域中,学者们通过探索与研究犯罪人的目的和心理,并结合实际来归纳犯罪类型,分析犯罪形式、预测犯罪趋势、纠正社会不良风气,达到控制社会犯罪率的目的。因此,犯罪的研究早已离不开对个体心理的分析。笔者通过动机心理学中的核心解释,结合当下中国的犯罪论体系进行说明,分析一个动机演化成为犯罪心理并付诸犯罪行动的过程,构建相应的犯罪倾向图形模型,对犯罪行为的产生的机率进行趋势分析。
In recent years, the rapid development and influence of criminal psychology have shown us a significant role in analyzing criminal behavior and predicting social security. In judicial practice, after a crime is defined, the analysis of the psychology of criminal subject can not only play an important role in conviction and sentencing, but also verify the legal admissibility of objective evidence. In the academic field, scholars aim to control the crime rate of the society by exploring and studying the purpose and mentality of the criminals, combining the reality with the types of crimes, analyzing the forms of crime, predicting the trend of crime, and correcting the social unhealthy trends. Therefore, the study of crime has long been inseparable from the analysis of individual psychology. Through the core explanation in motivation psychology and the current criminal theory system in China, the author analyzes the process of a motivation evolving into a criminal psychology and putting it into criminal operation, and constructs the corresponding graphical model of criminal tendency to analyze the probability of criminal behavior Conduct trend analysis.
