恶意诉讼随着社会发展,其形式和数量也日益繁多。其产生的原因较为多样,对社会司法造成的影响也日益严重,对恶意诉讼进行规制则有其必要性。应当主要从立法和司法两方面对恶意诉讼进行规制,并借鉴国外的合理制度,使我国朝着法治国家迈进。
Malicious litigation with the social development, its form and the number is also growing. The reasons for its occurrence are diverse and the impact on the social justice is also getting worse. It is necessary to regulate malicious litigation. Should mainly from the legislative and judicial aspects of the malicious litigation regulation, and learn from the reasonable system of foreign countries to make our country toward the rule of law.
