当前一个时期,法学、司法教育界的一些学者,以所谓“创新司法鉴定制度,保障司法效率与公正”为中心内容,或座谈研讨,或著书立说,或通过《中国司法鉴定》等刊物发表论文,就所谓公安机关“自侦自鉴”是“违法办案”妄加非议,同时力倡“鉴侦分离”,由司法行政机关组建“司法鉴定委员会”统揽全国的物证鉴定机构云云。对此苏沪两地新老文检工作者于2002年4月9日至11日在江苏常熟市举办了一次专题研讨会。会上大家取得了共识,会后写成《加强刑事科学物证鉴定技术工作学术研时会纪要》分报有关领导机关,以供决策参考,并冀望于“一石击起千层浪”,以期引起广泛的关注。针对公安机关拥有刑事科学物证鉴定机构,从事物证鉴定工作是“自侦自鉴”的“违法办案”的论点,讨论会认为这是对刑事技术工作的曲解。一些学者就所谓的“自侦自鉴”大做文章。其一说“鉴定人参加鉴别活动即属‘自侦自鉴’”,“如果侦查技术人员在参加取证活动后又参加鉴定活动就构成‘自
