教育行政纠纷是高校管理中不可回避的问题,在现实生活中纠纷好像是一种消极的现象,人们往往采取回避和否定的态度,其实并不是这样,有了纠纷才有法治的进步,所谓理不辨不清。在研究教育行政纠纷时,首先要研究学校与学生之间的法律关系,只有明确了各自法律关系,才能提升高校与学生相互之间处理行政纠纷的能力,确保学校的管理权,维护学生的基本权益。
Disputes over education in administrative management are unavoidable issues in the management of colleges and universities. Disputes in real life seem to be a negative phenomenon. People often adopt the attitude of avoiding and negating. In fact, this is not the case. Do not distinguish unclear. When studying educational administrative disputes, we must first study the legal relationship between schools and students. Only by clarifying their respective legal relationships can we improve the ability of colleges and students to handle administrative disputes with each other, ensure the management of schools and safeguard students’ basic knowledge rights and interests.
