无罪推定思想最早由意大利法学家贝卡利亚于 176 4年提出 ,法国的《人权宣言》首先予以采纳。严格地说 ,我国1996年修改后的《刑事诉讼法》并未完全给予肯定。为体现诉讼民主和文明 ,最终实现诉讼公正 ,我国应将无罪推定确认为刑事诉讼法的基本原则。
The concept of presumption of innocence was first proposed by the Italian jurist Beccaria in 176 4, and France’s “Declaration of Human Rights” was first adopted. Strictly speaking, the “Criminal Procedure Law” amended in 1996 in our country has not been completely affirmed. In order to reflect the democracy and civilization of the litigation, and finally realize the justice of the litigation, our country should confirm the presumption of innocence as the basic principle of the criminal procedure law.
