供应商是政府采购的直接参与者,也是政府采购工作最有力的监督者。供应商对采购活动中不合理的损害自己合法权益的行为可以进行质疑、行政复议、行政诉讼。然而现实中,由于政府作为采购主体权力强大,同时又作为质疑、复议程序的受理机关,很难做到救济的公正,对采购主体进行监督和制约。所以本文重在分析当前供应商救济机制存在的问题和缺陷,设法探讨一些可行的方案。
Suppliers are direct participants in government procurement and the most powerful watchdog of government procurement. The supplier may challenge, unreasonably injure the lawful rights and interests of the purchaser in its procurement activities, and make administrative reconsideration and administrative litigation. However, in reality, because the government is powerful as the main body of procurement and at the same time it is difficult for the authorities receiving the procedure of questioning and reviewing to do justice to remedy and supervise and restrict the procuring entity. Therefore, this article focuses on the analysis of the current supplier relief mechanism problems and shortcomings, try to explore some feasible solutions.
