宪法学基础性研究中易出现的错误是混淆宪法现象和宪法学概念 ,将立宪社会现实生活的矛盾、宪法矛盾和宪法学中的矛盾混为一谈 ,误解被抽象对象与抽象结果之间的关系 ,不懂得什么是抽象力以及如何获得和运用抽象力。《法学研究》2 0 0 1年第 4期上发表的周叶中等所写的《宪法学理论体系的反思与重构》一文 ,为这类典型错误提供了种种可用以剖析的例证。
The mistakes in basic research of constitutional law are to confuse the concepts of constitutional law and constitutionalism, to confuse the real life contradictions, constitutional contradictions and constitutional contradictions in constitutional society, to misunderstand the relationship between abstract objects and abstract results, and not to Understand what is abstraction and how to acquire and apply abstraction.
