罢免权是选举权的延伸,是选民权利的重要组成部分,罢免权体现了选民对当选人的监督和制约。但《村民委员会组织法》对村民如何罢免村民委员会成员这个问题,规定得不够完善、缜密,不利于保护选民的民主权利。笔者试图从地方性法规对罢免程序所作的规定上得到启发,对罢免这一重要程序作出法律构想。
The right to recall is an extension of the right to vote and is an important part of the rights of voters. The right of removal reflects the supervision and restriction of voters on the elected people. However, the “Organic Law of the Villagers’ Committee” regulates the issue of how villagers should be dismissed from villagers’ committees because the provisions of the Organic Law of the Villagers’ Committee are not perfect and meticulous enough to protect the democratic rights of the voters. The author tries to get enlightenment from the regulations made by the local laws and regulations on the recall procedure and make the legal conception on the important procedure of removal.
