我国行政听证制度起步较晚,到目前为止发展也不完善,对行政听证制度也没有进行系统的立法和制度规范。要促进我国的法治建设和实现法治国的理想,就必须要广大人民和全社会的广泛参与,而听证制度能够很好的解决行政机关在行政过程中所遇到的阻力,公开、公正、透明不仅是立法的生命,也是行政执法所必须遵循的准则。因此建立和完善我国的听证制度乃是法治的必然。
The administrative hearing system in our country started relatively late, so far the development is not perfect, and there is no systematic legislation and system norms for the administrative hearing system. To promote the construction of the rule of law in our country and realize the ideal of the country ruled by law, extensive participation by the broad masses of people and the entire society must be required. The hearing system can well solve the resistance, openness, fairness and transparency that administrative organs encounter in administrative processes It is not only the life of legislation, but also the guideline that administrative law enforcement must follow. Therefore, establishing and perfecting the hearing system in our country is the inevitable result of the rule of law.
