在世界金融竞争日益加剧和金融法制发生巨变的背景下,为了研究和交流金融法治变革的制度和法律措施,应韩国有关机构的邀请,2012年3月27日至3月31日,中国证券法学研究会会长、中央财经大学法学院院长郭锋教授率中国证券法学研究会代表团赴韩国进行了访问。访问团成员包括常务副会长、北京大学法学院甘培忠教授,副会长清华大学法学院施天涛教授,北京大学法学院蒋大兴教授,北京大学法学院彭冰副教授,中央财经大学法学院邢会强副教授,中国人民大学法学院董新义博士后,中国信托业协会自律监督部副主任(主持工作)韩志坚,山西信托有限公司法务总监魏冬冬。代表团访问考察了韩国总统府(青瓦台)、韩国金融委员会、金融监督院、韩国交易所、韩国金融投资协会、高丽大学法学院、韩国投资证券、弘益大学,并举行了多场专题座谈会,受到了相关单位的亲切接待,获得了许多珍贵的一手资料。郭锋会长还在高丽大学法学院作了《中国资本市场的立法现状及未来展望》讲座,受到了高丽大学师生的高度评价,引起了巨大的反响。另外,作为访韩的一个重要成果是中国证券法学研究会与韩国投资证券株式会社(韩国综合金融实力排前三名、证券领域雄踞韩国第一位)签订了《合作备忘录》,为今后研究会与韩国证券界开展产学研合作奠定了基础。通过这次访问,代表团对韩国的《资本市场法》的制定背景、核心制度、金融监管体制、金融投资者教育等有了非常全面和深刻的认识,对多年以来韩国推动金融立法变革和金融监管体制改革所作出的努力和经验做法等有了切身的感受,并与韩国金融监管机关、金融公司、高校、企业相关认识建立了友好的关系。本报告是中国证券法学研究会代表团访韩考察报告。现提供给有关部门及专家,以供参考。
In the context of the increasing financial competition in the world and the tremendous changes in the financial legal system, in order to study and exchange institutional and legal measures for the financial rule of law reform, at the invitation of relevant Korean institutions, from March 27 to March 31, 2012, China Securities Law Professor Guofeng, president of the Institute and the dean of the School of Law of the Central University of Finance and Economics, led a delegation of China Securities Law Research Association to visit South Korea. The delegation visited the Korean Presidential Office (Cheong Wa Dae), the Korea Financial Commission, the Financial Supervision Institute, the Korea Exchange, the Korea Financial Investment Association, Korea University Law School, Korea Investment Securities, Hongik University and held several symposiums , Received by the relevant units cordial reception, access to many valuable first-hand information. President Guo Feng also gave a lecture entitled “Legislation Status and Future Prospects of China’s Capital Market” at Korea University Law School. He received high praise from teachers and students of Korea University and aroused great repercussions. In addition, as an important result of visiting South Korea, China Securities Law Research Institute has signed a Memorandum of Cooperation with South Korea Investment Securities Co., Ltd. (the top three financial experts in Korea and No.1 in the securities field in Korea) It will lay the foundation for the cooperation with universities and research institutes in South Korea’s securities industry. Through this visit, the delegation has a very comprehensive and profound understanding of the background, the core system, the financial regulatory system, and the education of financial investors of the “Capital Market Law” in South Korea. For many years, South Korea has promoted the reform of financial legislation and the financial The efforts made in supervising the reform of the regulatory system and the experience and practices that have taken place, and have established friendly relations with the relevant knowledge of the financial regulatory authorities, financial companies, universities and enterprises in Korea.
