迄今为止,信访制度作为具有中国特色的独创的权利机制,是公民与政府的基础性交流渠道和维护社会公正等宪政价值的有效机制,在维持社会稳定、弥补法治真空、制约政府权力等方面具有不可替代的重要地位和作用。本文运用经济成本理论出发分析信访制度的固定与变动成本等相关因素,探究信访制度的成本问题的及时、全面、有效的解决之路。
So far, the petition system as an original right system with Chinese characteristics is an effective mechanism for the fundamental channels of communication between citizens and the government and for the maintenance of social justice and other constitutional values. It has the following functions in maintaining social stability, making up for the vacuum of rule of law, and restricting the government’s power Irreplaceable important position and role. In this paper, we use the economic cost theory to analyze the factors such as the fixed and variable costs of the petition system, and explore a timely, comprehensive and effective solution to the cost problem of petition system.
