现代程序价值观的演进中实际暗含了经济法的社会利益为本位的法律精神 ,这是中国经济程序法存在之可能性及其必要性的客观反映。同时 ,经济程序法本身也可以为中国经济法的存在和成长提供外在支持 ,这是由现代程序法本身的价值功能目标所决定的。中国经济法完全可以通过程序理性而使得自身的法精神得以体现。
The evolution of modern procedural values actually implies the legal spirit of the social interests of economic law. This is an objective reflection of the possibility and necessity of the existence of China’s economic procedural law. At the same time, economic procedural law itself can provide external support for the existence and growth of China’s economic law, which is determined by the value function of modern procedural law itself. China’s economic law can make its own legal spirit manifest through procedural rationality.
