国外对华反倾销调查大多由商会发起,而我国商会在反倾销申诉领域的作用发挥极其有限,主要是由于商会自身不完善、政府管理不科学和法律法规的不健全等原因所导致的。因此,商会需要调整结构,进行自我完善;政府应准确定位,加强与商会的合作,同时应加强监管。应制定《社团组织法》,明确商会的法律地位和职能,并完善反倾销法的相关规定。
Anti-dumping investigations against foreign countries in China are mostly initiated by chambers of commerce. However, the role of chambers of commerce in anti-dumping complaints is extremely limited. This is mainly due to the imperfections of chambers of commerce, the unscientific management of government and the imperfect laws and regulations. Therefore, the Chamber of Commerce needs to adjust its structure and make its own improvement. The government should accurately locate and strengthen cooperation with the Chamber of Commerce and at the same time strengthen supervision. The Law on the Organization of Associations should be formulated to clarify the legal status and functions of chambers of commerce and improve the relevant provisions of anti-dumping laws.
