在现行的“宽严相济”的刑事政策之下刑事代理制度对于提高程序正义和实体正义以及诉讼效益起到了重要作用。本文着手于探讨刑事诉讼中公诉案件被害人代理问题,目的在于:希望能够借此文章唤醒和拓宽对被害人权利保护之认识同时通过对刑事诉讼代理制度相关问题的阐述能够更进一步的使大家了解刑事诉讼代理制度在公诉案件中存在的问题。
