澳大利亚在对其版权法的多次修订中均涉及到图书馆的版权保护问题,在图书馆使用版权方面积累了较为成功的经验。澳大利亚首先对适用版权的图书馆性质进行了界定,并规定了图书馆版权流转的规则:合理使用;照顾公共利益;商业供应检验法等。除此之外,澳大利亚还实施知识共享许可协议来解决公共部门信息获取与再利用中的版权保护问题。文章对此进行了分析,并揭示其对我国图书馆界的借鉴意义。
Australia has been involved in copyright protection of libraries for many times in the revision of its copyright law and has accumulated more successful experience in the use of copyright in libraries. Australia first defined the nature of the library to which copyright was applicable and set forth the rules governing the circulation of copyright in libraries: fair use; taking care of the public interest; and the test of commercial supply. In addition, Australia also implements knowledge sharing licensing agreements to address copyright protection in the public sector’s access to and reuse of information. The article analyzes this and reveals its reference to our library community.
