《订单农业法律指南》是国际统一私法协会协同联合国粮农组织、国际农业发展基金共同出台的关于订单农业的最新国际性规范文件,是反复磋商、数次打磨之精良之作。其对作为订单农业核心的农业生产合同进行周密设计和详细分析,涵纳合同当事人、合同的成立和合同形式、当事人义务、免责事由、违约救济、合同期间、续约和终止、纠纷解决等诸多方面。《指南》为确保订单农业当事人间的公平,以国际性文件的方式构想农业生产合同每一环节可能出现的问题,并提出可行的解决方案及预防措施。《指南》能为订单农业中的产购双方当事人提供重要的合同参考,也可作为各国国内订单农业立法的模本,在一定程度上开启了订单农业合同的统一化时代,有助于世界订单农业的有序、稳健发展。
The Order Agriculture Law Guide is the latest international normative document on contract farming jointly issued by the International Institute of Private Law in collaboration with the UN Food and Agriculture Organization and the International Fund for Agricultural Development. It is an elaborate work that is repeated and polished several times. It carefully designs and analyzes in detail the contract of agricultural production which is the core of the order agriculture. It includes many aspects such as the contract parties, the contract establishment, the form of the contract, the obligation of the parties, exemption, remedy of default, term of the contract, renewal and termination, dispute resolution and so on aspect. In order to ensure fairness between the parties involved in the order, the Guidebook envisions the problems that may arise in every aspect of agricultural production contracts in the form of international documents and proposes feasible solutions and preventive measures. The Guide can provide an important contract reference for both purchasers and purchasers in order farming, and can also be used as a model for domestic agricultural orders in some countries. This guide to a certain extent has opened the era of unification of orders for agricultural contracts and helped the world to place orders Agricultural orderly and steady development.
