随着世界各国实行了“放松管制”的经济政策,大多数被监管的行业已经不再能够从反垄断法得到豁免。然而,另一方面,由于这些行业仍然存在着政府监管,这些监管机构和反垄断执法机构就不可避免地存在管辖权的冲突。本文讨论了反垄断法在被监管行业的作用,包括行为监管和结构监管,此外还提出反垄断执法机构和行业监管机构在这些行业的反垄断执法中应当相互协调和密切合作。
With the implementation of “deregulation” economic policies in all countries in the world, most regulated industries are no longer exempt from antitrust laws. However, on the other hand, as these industries still have government regulation, these regulatory agencies and antitrust law enforcement agencies will inevitably have jurisdictional conflicts. This article discusses the role of antitrust law in regulated industries, including behavior regulation and structural regulation. It also proposes that antitrust law enforcement agencies and industry regulators should coordinate and closely cooperate in antitrust enforcement in these industries.
