2016年10月1日,《湖北省土壤污染防治条例》(以下简称《条例》)正式开始实施。该条例是我国第一次对土壤保护的专门立法,也是我国土壤保护工作的一项重大进步。其中关于土壤污染防治区划的规定未明确提出,却规定于各个章节之中。本文通过对《条例》中土壤污染防治区划制度的总结介绍,引出《条例》中该项制度的合理之处以及不足之处,然后对全国性土壤让污染防治法的制定提出相关建议。
October 1, 2016, “Hubei Province Soil Pollution Prevention Regulations” (hereinafter referred to as “Ordinance”) officially began. This regulation is the first special legislation on soil protection in our country and a major step forward in soil protection in our country. Among them, the provisions on soil pollution prevention and control zoning are not clearly put forward, but they are stipulated in various chapters. In this paper, we summarize and introduce the system of soil pollution prevention and control in the “Regulations”, introduce the reasonableness and inadequacies of this system in the “Regulations”, and then put forward some suggestions on how to make the pollution prevention and control law nationwide.
