房地产是土地、土地权益以及地上建筑物、构筑物等房屋的合称。房地产法是确认和保障房地产权益,规范房地产开发、交易和使用乃至保障行为等活动的综合法律部门。自改革开放以来,房地产法律体系经历了一个不断发展完善的过程。当前我国房地产法律体系中存在城乡二元化结构、房产法和地产法的二元结构以及行政管理法和民事权利法的二元结构。房地产法学内容体系构建中应该妥当回应房地产法律体系的二元结构,应该在房地产综合法律体系的框架下,努力将房地产开发、交易、权属、使用乃至保障等领域的社会纠纷法律化。
Real estate is land, land rights and the ground buildings, structures and other houses collectively. Real estate law is to confirm and protect real estate rights and interests, norms of real estate development, trading and use of security activities and other activities of the comprehensive legal department. Since the reform and opening up, the legal system of real estate has undergone a continuous development and improvement process. At present, there exists the dual structure of dual structure of urban and rural areas, the dual structure of real estate law and real estate law and the dual structure of administrative law and civil law. Real estate law content system should properly respond to the dual structure of the real estate legal system, and should try to legalize social disputes in real estate development, trading, ownership, use and even security in the framework of the real estate comprehensive legal system.
