根据单位组织体责任论,单位制度瑕疵彰显单位危险人格,当单位危险人格连续引发单位犯罪时,适用单位累犯制度并不违背累犯的一般原理。单位累犯制度包含两个层面,在形式层面是因单位危险人格对单位加重处罚:在实质侧面则是因单位利益群体之行为偏差,进而对其加重处罚。不同于一般累犯,单位过失犯罪及单罚制罪名均可彰显单位之危险人格,具备成立单位累犯的可能性;在单位初犯与再犯之间,因单位组织形式发生变动以致有单位利益成员加入时,适用单位累犯制度并不违背刑法人权保障功能。
According to the organizational unit responsibility theory, flaws in the unit system highlight the dangerous personality of the unit.
