在我国的刑事诉讼程序中,检察机关的职能主要有三项:对特定案件进行侦查,提起公诉和对刑事诉讼过程进行法律监督。修改后的刑事诉讼法使控审职能进一步分离,检察机关的指控、举证责任进一步加重,客观上使人民检察院的公诉形象更加突出,而其法律监督职能却在理论与实践中显现出与公诉职能和诉讼结构的不协调性。检察机关的法律监督职能按照诉讼阶段可以分为侦查监督、审判监督和执行监督。其中最具争议的是审判监督。本文认为应在立法、司法以及检察机关自身素质等方面不断完善,以及审判监督职能得以最佳程度的发挥。
In our criminal procedure, there are mainly three functions of procuratorial organs: investigation of specific cases, prosecution and legal supervision over the process of criminal procedure. The amended Criminal Procedural Law further separates the functions of the accused and the accused, the prosecution’s allegation and the burden of proof further aggravate, objectively making the image of the people’s procuratorate’s prosecution more prominent, and its legal supervisory function shows the function of prosecution in both theory and practice And the litigation structure is not harmonious. The legal supervisory function of procuratorial organs can be divided into investigation supervision, trial supervision and implementation supervision according to the stage of litigation. One of the most controversial is the trial of supervision. This paper argues that the legislation, judicature and the quality of procuratorial organs themselves should be continuously improved and the function of trial supervision should be optimized.
