宪法权威的树立,在于宪法能够对政治实践具有现实的规范和控制能力,对违宪行为产生足够的威慑力量。近代以来的宪政实践表明,设置一套切实可行的宪法监督制度是确保宪法具有足够威慑力从而树立宪法应有权威,并进而实现宪法价值的最为有效的途径。因此世界各国从本国的社会现实和宪政实践需要出发建立了宪法监督机制。鉴于我国目前由于专门的宪法监督机关的缺失而导致的宪法监督成效不大的问题,建立一个一元多轨的宪法监督机制应该是我国目前较为可行的选择。
The establishment of constitutional authority lies in that the Constitution can have realistic norms and control over political practice and provide enough deterrent power to unconstitutional acts. The constitutional practice since modern times shows that setting a practical constitutional supervision system is the most effective way to ensure that the constitution has enough deterrent to establish the constitutional authority and thus the constitutional value. Therefore, all countries in the world set up the mechanism of constitutional supervision based on their own social reality and the need of constitutional practice. In view of the fact that the current constitutional supervision in our country is not effective due to the lack of a special constitutional supervision organ, establishing a one-nation and multi-track constitutional supervision mechanism should be a feasible option in our country at present.
