长江是流经多省的河流,为使长江的水路运输事业健康有序地发展,长江干线必须执行国务院和交通部颁发的有关水路运输法规和规章。国务院发布的《中华人民共和国水路运输管理条例》第六条规定:“从事水路运输和水路运输服务业务的单位和个人,必须遵守国家有关法律、法规及交通部发布的水路运输规章。”一条流经多省的河流为了使各航运企业和港埠企业有一个公平、公正的运输市场环境,只能执行一个统一的标准,一个统一的法规和规章。但从目前长江的实际情况来看,还没有达到这样的状况。其原因是多方面的。
The Yangtze River is a river flowing through many provinces. For the sake of a healthy and orderly development of the waterway transportation in the Yangtze River, the Yangtze River Route must implement the relevant laws and regulations on waterway transportation promulgated by the State Council and the Ministry of Communications. Article 6 of the Regulations of the People’s Republic of China on the Administration of Waterways Transport promulgated by the State Council stipulates: “All units and individuals engaged in the business of waterway transportation and waterway transportation must abide by the relevant laws and regulations of the State and the regulations on waterway transportation promulgated by the Ministry of Communications.” In order to have a fair and equitable transport market environment for shipping companies and port enterprises, only a single standard, a unified set of rules and regulations can be implemented.
