民事执行检察监督是破解民事执行难、执行乱的重要手段,虽然2012年《民事诉讼法》确立了民事执行检察监督的法理地位,但是民事执行检察监督的具体法律制度依然缺失。本文对广西H市基层检察院民事执行检察监督情况进行考察,发现受理的民事执行检察监督案件增长,监督范围广泛、监督方式多样,民事执行检察监督效果并不如意。通过分析实践的困境指出出路在于完善检察监督法律制度、提升民事执行检察监督理论研究和科学制定考评机制。
Prosecutorial supervision over civil execution is an important means to crack down on civil enforcement and execution. Although the Civil Procedure Law of 2012 established the legal status of procuratorial supervision over civil execution, the specific legal system of procuratorial supervision over civil execution is still missing. This article examines the implementation of procuratorial supervision in the grassroots procuratorate of H City, Guangxi Province, and finds that the number of civil execution procuratorial supervision cases accepted by the government is increasing, the scope of supervision is extensive, the supervision methods are varied, and the effect of procuratorial supervision in civil execution is not satisfactory. By analyzing the plight of practice, we point out that the way to go is to improve the legal system of procuratorial supervision, enhance the theoretical research on procuratorial supervision of civil execution and scientifically establish the evaluation system.
