本文阐述了船舶保险中委付的法律特征。在介绍关于委付的若干观点之后,作者指出了委付作为欲取得推定全损索赔权所具有的法律特征是:1.必须在所规定的期间内提出;2.是单方的法律行为;3.委付具有选择性。委付作为愿让与保险标的物产权的法律特征是:1.委付具有单纯性;2.委付是双方的法律行为。
This article elaborates on the legal features entrusted to ship insurance. After introducing several views on delegation, the author points out that the legal features of the delegation as a claim for total imputed damages are: 1. Must be made within the period specified; 2. Unilateral legal acts; 3 Discretion is optional. The legal characteristics of the property rights as the subject of grant and insurance are as follows: 1.
