专利申请日至专利申请公布或者公告日期间对提出专利申请的技术是专利申请人的商业密秘。应根据《中华人民共和国反不正当竞争法》给予保护。依照专利法的规定,申请专利的技术在其公开日(公布日或公告日)以前应当严格保密,而且,专利申请人也不应付诸实施和转让。非有关人员是不能合法地获得专利申请的技术内容的。对此《最高人民法院关于审理专利纠纷案件若干问题的解答》中有明确
