案情回放:跨村买房发生纠纷2012年5月17日,汇湾乡小河村一组村民刘某与青龙村三组村民马某签订房屋买卖协议,将其位于小河村一组的房屋四间作价12万元卖给马某,双方约定签订协议之日给付4万元,10月5日搬家时再付6万元,其余2万元于同年12月20日前付清,如违约按20%支付违约金。期间,刘某将房屋过户给马某。后因2万元尾款逾期未付,双方发生纠纷。刘某诉至法院,请求判决马某给付尾款2万元并支付相应的违约金。马某则认为,不在同一集体经济组织的农村房屋买卖合同因违反法律法规的强制性规定而无效,请求确认房屋买卖协议无效,返还购房款。
