知识产权质押担保是解决科技型企业融资难的重要措施。尽管《物权法》为知识产权质押融资提供了法律依据,但由于《专利法》等内在法律的分歧,外部市场环境支撑不力,我国现阶段知识产权质押有着较大困扰。故,探寻知识产权质押存在的问题,寻找解决困扰的对策对于构建良好的知识权质押环境具有重要的现实意义。
Intellectual property pledge guarantee is an important measure to solve the financing difficulty of science and technology enterprises. Although the Property Law provides the legal basis for pledge financing of intellectual property, due to the disagreement of the inherent laws such as the Patent Law and the weak external market environment, the current pledge of intellectual property in our country has been greatly troubling. Therefore, it is of great practical significance to explore the existing problems of pledge of intellectual property and to find a solution to the problem of plight for building a good environment of pledge of knowledge.
