《民法通则》的意见以及《合同法》中均有房屋承租人享有优先购买权的规定,但是规定有不一致,在法律适用的过程中也有不少问题存在,比如与房屋共有人的优先购买权的冲突,以及“同等条件”的含义,实践中承租人维权的困境。本文将以案例作为引导,分析这些问题并探讨解决之道。
Opinions of the “General Rules of Civil Law” and “Contract Law” both provide preemptive rights to tenants. However, there are inconsistencies and many problems exist in the application of the law, such as preemptive rights with the common owners Conflict, as well as the meaning of “equal conditions”, in practice, lessees’ rights protection. This article will take the case as a guide to analyze these issues and explore solutions.
