当前我国正在进行《专利法》第四次修改,专利行政保护的去留问题再一次成为争议的焦点。经研究发现,近几年来,专利行政保护在我国的生长土壤依然肥沃,在实践中取得的绩效更加显著,社会对该保护方式的市场需求非常旺盛,因而建议适度加强专利行政保护,并对《专利法(修订草案送审稿)》第60条第2款的修改提出了完善建议。
At present, our country is carrying out the fourth revision of the “Patent Law,” and the issue of the removal and retention of patent administrative protection has once again become the focus of controversy. The study found that in recent years, the administrative soil protection of patent in our country is still fertile soil, the performance obtained in practice is more significant, and the market demand for this protection mode is very strong. Therefore, it is suggested that the administrative protection of patent be modestly strengthened, Amendments to Article 60, paragraph 2, of the Patent Law (Revised draft for review) put forward sound suggestions.
