研究目的:基于对家庭承包地流转价格形成之内在机理的分析,提出完善家庭承包地流转价格形成制度的相关建议。研究方法:法经济学分析法。研究结果:用法经济学分析法有效地分析了家庭承包地流转价格形成制度的内在机理,并据此提出了家庭承包地流转价格形成制度的完善建议。研究结论:零星流转价格形成制度应沿袭“当事人自由协商定价”的现行规定,而规模流转价格形成制度应规定为由承包户委托中介机构与受让方协商定价。
Research purposes: Based on the analysis of the internal mechanism of the price formation of household contractual transfer, suggestions are put forward to improve the price forming system of household contractual transfer. Research Methods: Law and Economics Analysis. Research results: Using the method of economic analysis, this paper analyzes the inherent mechanism of the price formation system of family contracted land transfer effectively, and puts forward the perfect suggestion of forming price system of family contract land transfer. Research conclusions: The sporadic transfer price formation system should follow the “free negotiation pricing of the parties,” the current regulations, and scale transfer pricing system should be provided by the contractor entrusted intermediaries and negotiators negotiated pricing.
