在人类法制和伦理思想史及道德文明史上,高度重视司法人员的道德人格在全社会的榜样示范作用是一种源远流长的优良传统。中国封建社会由于实行政法不分、民刑合一的体制,对行政官吏“政德”的要求其实也包含对司法官吏的“司德”要求。在实行依法治国、建设社会主义法治国家的过程中,高度重视和充分发挥司法人员的道德人格对全社会的积极影响,显得尤其必要。
In the history of human legal system and ethics and ideology and history of moral civilization, attaching importance to the exemplary moral character of judicial personnel in the whole society is a fine tradition with a long history. In China’s feudal society, due to the separation of political and legal systems and the integration of civil penalties, the requirements of administrative officials “political ethics ” also include the requirement of “judicial ” for judicial officials. In the process of administering the country according to law and building a socialist country ruled by law, it is especially necessary to attach great importance to and give full play to the positive impact of the moral personality of judicial personnel on the whole society.
