实习生权益保护不到位的问题日显突出。笼统地将实习生归入劳动法调整并不能解决问题,甚至会适得其反,进一步伤害实习生的基本权益。正确的做法应是从实习活动的人身性、财产性和教育性入手,分别确定法律的切入角度、方式和责任主体,协调劳动法、教育法和职业教育法甚至侵权责任法来共同规范,政府亦应起到牵头协调作用,方能既保护实习生的核心权益,也不损伤企业提供实习机会的积极性。
Intern protection of the rights and interests are not in place more prominent issues.
