职务犯罪嫌疑人外逃现象越来越严重,外逃官员的级别和数量皆呈现递增之势,引起了国家的高度重视。为了打击职务犯罪,海外追逃追赃无疑成为了重要工作之一。海外追逃追赃包括追人与追物,就追人而言,有引渡、遣返、异地追诉和劝返等途径,其中最正当、最主要的便是引渡。然现阶段,我国的引渡存在着签署的双边引渡条约数量不足、已签署引渡条约的利用率不高、双边友好协商方式运作艰难等困境,这严重阻碍了引渡工作的顺利进行。究其原因,在于主观和客观两大方面,本文从主客观两方面研究如何才能全面地打击职务犯罪,圆满地完成引渡职务犯罪嫌疑人这项工作。
The phenomenon of flight of job suspects is getting more and more serious. The rank and number of evacuees are showing an increasing tendency, which has drawn great attention from the state. In order to combat job-related crimes, it is undoubtedly one of the important tasks that overseas pursuit and recovery of stolen goods has taken place. In the pursuit of money, there are ways of extradition, repatriation, prosecution and exhortation in other places. The most proper and the most important one is extradition. However, at this stage, there are many difficulties in the extradition of our country, such as the insufficient number of bilateral extradition treaties signed, the low utilization rate of signed extradition treaties and the difficult operation of bilateral friendly consultation. This seriously hinders the smooth progress of extradition work. The reason lies in the two subjective and objective aspects. This article studies how to fully combat job-related crimes from the subjective and objective aspects and satisfactorily accomplish the task of extraditing job-related criminal suspects.
