刑法适用离不开刑法解释,但刑法解释不是可以肆意为之的,解释者必须遵循一定的限度。刑法解释的限度关系着保障自由与维护社会秩序的平衡。犯罪定型是刑法解释的真正限度。
The application of criminal law is inseparable from the interpretation of criminal law, but the interpretation of criminal law can not be arbitrary, the interpreter must follow certain limits. The limit of criminal law interpretation relates to the balance between guaranteeing freedom and maintaining social order. Crime stereotypes are the true limits of criminal law interpretation.
