迁徙自由是现代法治国家公民的一项基本人权,也是近代民主宪政条件下公民的一项重要的宪法权利。本文认为在我国恢复迁徙自由对推动经济发展、实现公平正义、履行国际承诺具有重要意义,现行宪法应当恢复确认迁徙自由,并根据我国国情逐步建立相应的法律保障体系,规范公民的迁徙行为,保障公民迁徙自由的权利。
Freedom of movement is a basic human right for citizens of the modern rule of law and an important constitutional right of citizens under the condition of democratic constitutionalism. This article holds that the restoration of freedom of movement in our country is of great significance to promoting economic development, realizing fairness and justice, and fulfilling international commitments. The current constitution should resume the recognition of freedom of movement and gradually establish a corresponding legal security system in accordance with China’s national conditions so as to standardize citizens’ migration and protection Citizens have the right to freedom of movement.
