实践型社会符号观关注话语社团为中心的语境运行及由此激活的语篇层面的语义运行,本研究据此提出实践型社会符号语类框架。针对当前司法判决书推理这一突出问题,选取一篇优秀民事判决书,重点论述该语料语篇元功能上的话语社团语境和“本院认为……”结构段的语义配置。分析表明当前司法裁判话语社团趋向于编码司法判决推理文本。案件事实的认定和法律规范的确认与适用,主要通过蕴涵同义关系链条、“涵射”语义关系链条和对立反义关系链条建构,而演绎形式推理主要通过主位交叉型推进模式、述位集中型推进模式和主位派生型推进模式三种横向主位推进链条组织法律推理的信息结构。
The practical social symbolism focuses on the discourse community-centered context operation and the discourse-level semantic operation thus activated. Based on this, this study proposes a practical social symbolic framework. Aiming at the prominent problem of reasoning in current judicial judgment, this article selects an excellent civil judgment and focuses on the metaphorical discourse context of the meta-discourse function and the semantic configuration of the structural segment of “the court believes that ...”. The analysis shows that the current judicial adjudication discourse societies tend to encode reasoning texts for judicial decisions. The confirmation of the facts of the case and the confirmation and application of the legal norms mainly through the construction of the chain of semantic relations and the antisense relations of antisense which contains the chain of synonymous relations, The three types of information structures that promote the legal reasoning of the chain organization are the three kinds of horizontal themes that promote centralized mode of advocating position and the mode of derivation of dominant position.
